PUBLIC PARTICIPATION IN THE PREPARATION OF DEVELOPMENT PLAN

 

The challange of a development pattern striving to harmonize economics with social and environmental needs requires active citizen participation in public issues. Public participation in decisions about development is fundamental to achieving lasting and possible solutions.

Modern democratic life requires an active role from the population and needs participation from members of the community. It should no longer be the case that those who are governed act only to elect and then, whatever the outcome, are governed without having opportunities to interact with their representatives. It is time to add the idea of participation to the concept of representative democracy.

Participation transform the democratic system, energizing it, by creating a permanent connection between the governed and those who govern. The joint venture permits more reasoned decisions (being these the product of a higher consensus), enables a better understanding of the problems that preoccupy a society, and allows the two parties to work cooperatively towards possible solutions.

Public participation allows government actions to become transparent, effectively avoiding corrupt behaviors. It also clarifies responsibilities and facilitates the eventual application on sanctions, in case of reproachable conducts.


What is the role of the public in the preparation of development plan?

 

Public participation is an important process of planning in order to ensure development plan can fulfill the needs and aspirations of the community. In the context of preparation of development plan, public participation is done at the publicity stage of the reports.

The requirement of publicity has been provided for in the Town and Country Planning Act 1976 (Act 172), under the subsection 9(1) whereby:

 

The State Director should ensure that publicity is given while preparing the draft development plan for its area and shall take the following steps:

 

 

 

  •  

Inform the public that they are entitled to, and are given an opportunity to make representations to the State Director in respect of the development proposal in the development plan, through briefing, phamplets, exhibitions, media anouncement etc;

 

 

 

 

  •  

Publish, in three issues of at least two local newspapers, a notice stating that copies of the plan are available for inspection at the office of State Director and such other places and the time within which objections to the plan may be made to the State Planning Committee; and 

 

 

 

 

  •  

Make copies of the plan available for inspection at the places stated in the notice; and each copy shall be accompanied by a statement of the time, as stated in the notice, within which objections to the plan may be made to a special committee.

 

 

 

 

   

Section 12A, Act 172 :

 

 

 

Publicity is given in its area to the draft local plan that will be prepared, its objectives and the purpose for its preparation, and matters related that the local planning authority proposes to include in the plan; and that persons who may be expected to desire an opportunity of making representations to the local planning authority in respect of those matters made awared that they are entitled to, and are given an opportunity of doing so.

 

Section 13, Act 172 :

 

 

 

 

The local planning authority should make copies of the draft local plan available for inspection at its office and at such other places as it may determine; and each copy made available for inspection shall be accompanied by a statement of the time, as stated in the notice published under subsection (2), within which objections to or representations in respect of the draft local plan may be made to the local planning authority. 

 

 

 

 

Before making copies of a draft local plan available for inspection, the local planning authority shall publish, in three issues of at least two local newspapers, one of which being in the national language, a notice stating the date on which copies of the draft local plan will begin to be available for inspection, and the time, which shall not be less than four weeks from the date of which copies of the draft local plan begin to be available for inspection, with which objections to or representations in respect of the draft local plan may be made to  the local planning authority; and  

 

 

 

 

Subsection 13(3) provided that the time stated in the notice under subsection (2) for the making of objections to or representations in respect of the draft local plan may be extended once by the local planning authority by not more than four weeks on the application of any person.

 

 

 

How to give your suggestions and objections?

 

 

 

 

  • The public can inspect report of Draft Structure Plan or Draft Local Plan at the following places:
  •  

     

     

     

     

     i. Office of local planning authority; and

     

     

     ii. Office of State Town and Country Planning Department.

     

     

     

     

  • Fill the forms provided; or
  • Fill the forms provided online through the JPBD's homepage;
  • Submit your suggestions or objections by email to e-complaints@Town and Country Planning
  • Everyone who made submission will be called to make representation to a special committee.
